New Provision of Safe Homes Act Emphasizes Tenant Safety from Domestic Violence

On January 1, 2026, a new requirement under Illinois’ Safe Homes Act took effect, impacting landlords and tenants of privately owned residences. Landlords (building owners or their agents) who rent residences are required to provide all tenants with a “Summary of Rights for Safer Homes.” The summary must appear as the first page of every new and renewal leave.

Key to the expanded law is the tenant’s ability to terminate a lease and permanently vacate a property within three days before or after providing written notification of a credible and imminent threat of domestic or sexual violence at the rental unit. No formal complaint, police report or court order is required to invoke the right to terminate. A similar provision allows tenants to change the locks if a landlord does not do so within 48 hours following a request and written notification of an imminent threat of domestic or sexual violence.

Tenants are responsible only for rent due for the period before providing written notice, and landlords may not assess “early lease break fees. Security deposits can be applied to any due, unpaid rent or damage beyond reasonable wear and tear.

GNP’s residential management arm is actively educating its owners and landlords on the new provisions and training property managers on the law and how to handle any issues that may arise. John Ribando, executive vice president, residential management, is mindful of the need to balance owners’ interests with tenants’ rights in any given situation, Renata Stec, executive vice president and managing broker for GNP Realty Partners, reports.

 “While we recognize the potential abuse of the law by a tenant seeking to terminate a lease early with no financial repercussions, we prioritize tenant safety and will always adhere to the law,” says Stec.

The Illinois Coalition Against Sexual Assault provides information about the 2007 Safe Home Acts and the new Summary of Rights for Safer Homes, as well as resources and confidential assistance for Illinois residents who are victims of domestic or sexual violence.
